GİRİŞ VE YETKİLİ HUKUK

İşbu Kullanım Şartları, merkezi Secaucus, Hudson, New Jersey, Amerika Birleşik Devletleri’nde bulunan HaberFlash.Com internet sitesinin (“Site” veya “HaberFlash.Com”) kullanımı ile ilgili hüküm ve koşulları düzenlemektedir. Siteyi herhangi bir şekilde kullanan tüm kullanıcılar (“Kullanıcı”) bu şartları kabul etmiş sayılır.

İşbu Kullanım Şartları, Amerika Birleşik Devletleri’nin Federal Hukuku ve New Jersey Eyalet Kanunları’na tabidir.

BÖLÜM I: GENEL KULLANIM KOŞULLARI

1. Hizmetin Kullanımı

1.1. HaberFlash.Com, haber, analiz ve yorum içeriği sunan bir dijital platformdur. Kullanıcı, Sitedeki hizmetlerden yasalara ve işbu şartlara uygun olarak yararlanmayı kabul ve taahhüt eder.

1.2. Kullanıcı, Sitede yer alan içeriği ve görselleri, ticari amaçlarla veya kaynak belirtmeksizin kopyalamayacağını, çoğaltmayacağını, dağıtmayacağını veya işlemeyeceğini kabul eder. Aksi takdirde, Kullanıcı, ABD Telif Hakkı Kanunları (örneğin, 17 U.S.C. § 101 ve sonrası) kapsamında hukuki ve cezai yaptırımlarla karşı karşıya kalabilir.

1.3. Site, yalnızca 18 yaş ve üzeri kişilerin kullanımına yöneliktir. 13 yaşın altındaki çocuklardan bilerek kişisel bilgi toplamıyoruz ve Çocukların Çevrimiçi Gizliliğini Koruma Yasası (Children’s Online Privacy Protection Act – COPPA) hükümlerine uymaktayız.

2. Fikri Mülkiyet Hakları

2.1. Sitede yayımlanan her türlü içerik, görsel, video, tasarım ve yazılımın fikri mülkiyet hakları münhasıran HaberFlash.Com’a veya lisans sahiplerine aittir. Bu haklar, ABD Telif Hakkı (Copyright) ve Ticari Marka (Trademark) yasalarıyla korunmaktadır.

2.2. Kullanıcılar tarafından yorum, makale veya başka bir formatta Sitede yayımlanan tüm içerikler için Kullanıcı, HaberFlash.Com’a, söz konusu içeriği herhangi bir formatta, süresiz ve geri alınamaz bir şekilde kullanma, çoğaltma, değiştirme ve yayımlama hakkı veren dünya çapında, telifsiz bir lisans verir.

2.3. Telif hakkı ihlali iddiaları, Dijital Binyıl Telif Hakkı Yasası (Digital Millennium Copyright Act – DMCA, 17 U.S.C. § 512) uyarınca belirlenen usullere göre işleme alınır.

BÖLÜM II: SORUMLULUK VE TAZMİNAT

3. Garanti Reddi ve Sınırlı Sorumluluk

3.1. HaberFlash.Com, siteyi ve içeriklerini “olduğu gibi” (as is) ve “mevcut olduğu şekliyle” (as available) sunmaktadır. Site, içeriğin doğruluğu, güvenilirliği, kesintisizliği veya hatasızlığı konusunda açık veya zımni hiçbir garanti vermez.

3.2. New Jersey Eyalet Kanunları’nın izin verdiği en geniş kapsamda, HaberFlash.Com, Site kullanımından veya kullanılamamasından kaynaklanan hiçbir doğrudan, dolaylı, arızi, özel veya sonuçsal zararlardan (kar kaybı, veri kaybı, itibar kaybı dahil ancak bunlarla sınırlı olmamak üzere) sorumlu tutulamaz.

4. Tazminat

Kullanıcı, işbu Kullanım Şartları’nı veya yürürlükteki ABD/New Jersey yasalarını ihlal etmesi nedeniyle ortaya çıkan her türlü iddia, dava, zarar, yükümlülük, maliyet ve harcamaya (makul avukatlık ücretleri dahil) karşı HaberFlash.Com’u ve bağlı şirketlerini tazmin etmeyi, savunmayı ve zarar görmemesini sağlamayı kabul eder.

BÖLÜM III: KİŞİSEL VERİLERİN KORUNMASI VE GİZLİLİK

5. Gizlilik ve Veri İşleme

5.1. HaberFlash.Com, kullanıcı gizliliğine büyük önem verir ve kullanıcı verilerini yürürlükteki kanunlara uygun olarak işler. Kullanıcıların kişisel verilerinin toplanması, kullanılması ve açıklanması, yasal dayanaklarını başta New Jersey Veri Koruma Yasası (New Jersey Data Protection Act – NJDPA, P.L. 2023, c. 266) ve ABD Federal Ticaret Komisyonu (Federal Trade Commission – FTC) yetkileri olmak üzere, geçerli yasal mevzuattan almaktadır.

5.2. Kullanıcı verilerinin işlenmesi, saklanması ve korunmasına ilişkin detaylar, bu Kullanım Şartlarının ayrılmaz bir parçası olan Gizlilik Politikası’nda açıklanmıştır.

5.3. Kullanıcı, Gizlilik Politikası uyarınca kişisel verilerinin işlenmesine açıkça muvafakat eder. Kullanıcılar, NJDPA kapsamında kendilerine tanınan verilere erişim, düzeltme, silme ve verilerinin satışını/hedefli reklamcılık amacıyla işlenmesini durdurma (opt-out) haklarını kullanma yetkisine sahiptir.

BÖLÜM IV: HUKUKİ YAPTIRIM VE İHTİLAFLARIN ÇÖZÜMÜ

6. Uygulanacak Hukuk ve Yargı Yetkisi

6.1. İşbu Kullanım Şartları, New Jersey Eyaleti Kanunları’na göre yönetilir ve yorumlanır.

6.2. Kullanım Şartları’ndan veya Sitenin kullanımından kaynaklanan herhangi bir ihtilafın çözümünde, New Jersey, Hudson County (Secaucus’un bulunduğu bölge) Federal veya Eyalet Mahkemeleri münhasıran yetkilidir. Kullanıcı, bu mahkemelerin yargı yetkisini kabul eder.

INTRODUCTION AND GOVERNING LAW

These Terms of Use govern the provisions and conditions related to the use of the HaberFlash.Com website (“Site” or “HaberFlash.Com”), which is headquartered in Secaucus, Hudson, New Jersey, United States of America. All users (“User”) who use the Site in any way are deemed to have accepted these terms.

These Terms of Use are subject to the Federal Law of the United States of America and the Laws of the State of New Jersey.

SECTION I: GENERAL CONDITIONS OF USE

1. Use of the Service

1.1. HaberFlash.Com is a digital platform that provides news, analysis, and commentary content. The User agrees and undertakes to utilize the services on the Site in accordance with the law and these terms.

1.2. The User agrees not to copy, reproduce, distribute, or process the content and visuals on the Site for commercial purposes or without citing the source. Otherwise, the User may face civil and criminal penalties under US Copyright Laws (e.g., 17 U.S.C. § 101 et seq.).

1.3. The Site is intended only for use by individuals aged 18 and older. We do not knowingly collect personal information from children under the age of 13 and comply with the provisions of the Children’s Online Privacy Protection Act (COPPA).

2. Intellectual Property Rights

2.1. The intellectual property rights of all content, visuals, videos, designs, and software published on the Site belong exclusively to HaberFlash.Com or its licensees. These rights are protected by US Copyright and Trademark laws.

  1. For all content published on the Site by Users in the form of comments, articles, or any other format, the User grants HaberFlash.Com a worldwide, royalty-free license to use, reproduce, modify, and publish said content in any format, perpetually and irrevocably.

2.3. Copyright infringement claims are processed according to the procedures determined by the Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512).

SECTION II: LIABILITY AND INDEMNIFICATION

3. Disclaimer of Warranties and Limitation of Liability

3.1. HaberFlash.Com provides the Site and its contents “as is” and “as available.” The Site offers no explicit or implicit warranty regarding the accuracy, reliability, continuity, or lack of errors in the content.

3.2. To the fullest extent permitted by the Laws of the State of New Jersey, HaberFlash.Com shall not be held liable for any direct, indirect, incidental, special, or consequential damages (including, but not limited to, loss of profit, loss of data, loss of reputation) arising from the use or inability to use the Site.

4. Indemnification

The User agrees to indemnify, defend, and hold harmless HaberFlash.Com and its affiliated companies against any and all claims, suits, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from the User’s violation of these Terms of Use or applicable US/New Jersey laws.

SECTION III: PROTECTION OF PERSONAL DATA AND PRIVACY

5. Privacy and Data Processing

5.1. HaberFlash.Com attaches great importance to user privacy and processes user data in compliance with applicable laws. The collection, use, and disclosure of Users’ personal data derive their legal basis from applicable legal regulations, primarily the New Jersey Data Protection Act (NJDPA, P.L. 2023, c. 266) and the authorities of the US Federal Trade Commission (FTC).

5.2. Details regarding the processing, storage, and protection of user data are outlined in the Privacy Policy, which is an integral part of these Terms of Use.

5.3. The User explicitly consents to the processing of their personal data in accordance with the Privacy Policy. Users have the right, under the NJDPA, to access, correct, delete their data, and opt-out of the sale/processing of their data for targeted advertising purposes.

6. Governing Law and Jurisdiction

6.1. These Terms of Use shall be governed by and construed in accordance with the Laws of the State of New Jersey.

6.2. The Federal or State Courts of Hudson County, New Jersey (the area where Secaucus is located) shall have exclusive jurisdiction over the resolution of any dispute arising from these Terms of Use or the use of the Site. The User accepts the jurisdiction of these courts.
